1. Acceptance of Terms

By accessing and using the Gahanna Business Directory ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily use the Gahanna Business Directory for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display (commercial or non-commercial)
• Attempt to decompile or reverse engineer any software contained on the website
• Remove any copyright or other proprietary notations from the materials

3. Business Listings

3.1 Listing Accuracy

Business owners are responsible for providing accurate, current, and complete information about their business. You agree to update your listing promptly when information changes.

3.2 Content Standards

All business listings must:

• Be truthful and not misleading
• Comply with applicable laws and regulations
• Not contain offensive, inappropriate, or discriminatory content
• Not infringe on the rights of others
• Represent a legitimate business operation

3.3 Review Process

All listings are subject to review and approval. We reserve the right to reject, remove, or modify any listing that does not meet our standards or violates these terms.

4. Payment Terms

4.1 Subscription Plans

Standard, Featured and Sponsor plans are subscription-based services. Payment is due in advance for the selected term (monthly or annual).

4.2 No Refunds Policy

Due to the digital nature of our services, all payments are final and non-refundable. This includes but is not limited to:

• Standard listing subscriptions (monthly or annual)
• Featured listing subscriptions (monthly or annual)
• Sponsor banner subscriptions (monthly or annual)
• Any promotional or upgrade services

Once your listing is activated and published in our directory, the digital service has been delivered. We do not provide refunds for:

• Changes of mind after payment
• Unused portions of subscription periods
• Dissatisfaction with results or traffic
• Business closure or change of circumstances
• Duplicate payments or accidental purchases

In exceptional circumstances involving technical errors on our part, refunds may be considered at our sole discretion.

4.3 Cancellation

You may cancel your subscription at any time through your account dashboard. Cancellation will take effect at the end of the current billing period. No refunds will be provided for the remaining subscription period.

5. Prohibited Uses and Account Violations

5.1 General Prohibited Activities

You may not use our service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To upload or transmit viruses or any other type of malicious code
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• For any obscene or immoral purpose

5.2 False Information and Unauthorized Submissions

Providing false, misleading, or inaccurate information is strictly prohibited. This includes but is not limited to:

• Submitting a business listing for a business you do not own, operate, or have authorization to represent
• Providing incorrect contact information, addresses, or business details
• Creating fake reviews or testimonials
• Impersonating another business or individual
• Submitting duplicate listings for the same business
• Intentionally providing false or damaging information about competitors
• Creating listings for non-existent businesses

5.3 Consequences of Violations

Violations of these terms may result in:

• Immediate suspension or termination of your account
• Removal of your business listing(s)
• Forfeiture of any paid subscription fees
• Legal action if necessary
• Reporting to relevant authorities for fraudulent activity

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of the Gahanna Business Directory and its licensors. The Service is protected by copyright, trademark, and other laws.

7. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

8. Disclaimers

8.1 Service Availability

We strive to maintain high availability of our service, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or technical issues.

8.2 Business Information

While we review business listings for accuracy, we cannot guarantee the accuracy, completeness, or reliability of any business information. Users should verify information directly with businesses.

8.3 Third-Party Content

Our service may contain links to third-party websites or content. We are not responsible for the content, privacy policies, or practices of any third-party sites.

9. Limitation of Liability

In no event shall the Gahanna Business Directory, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

10. Indemnification

You agree to defend, indemnify, and hold harmless the Gahanna Business Directory and its licensors and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.

11. Governing Law

These Terms shall be interpreted and governed by the laws of the State of Ohio, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
